  • The opening online bid must be the stated minimum bid or higher
  • Bids will be made in amounts no less than the minimum bid required for each item and in competitive increments of $10 (CDN).
  • All online bids must be submitted by 10 April 2014, 12 pm
  • Online bids placed are firm commitments to purchase and may not be cancelled or retracted for any reason after 10 April 2014 at 12 pm
  • The highest bidder at online auction closing will be contacted on 11 April 2014 and should be prepared to provide a credit card number or other assurance to hold/secure the bid.
  • The highest secured online bid will be recorded on the corresponding art work’s Silent Auction Bid Sheet i.e. become the Opening Bid on the work at the UPwithART event
  • All bids are exclusive of all applicable taxes, customs duties, registration fees, shipping, rigging, or other preparation and transportation costs and insurance – winners are responsible for all costs of shipping and handling
  • Upon your becoming the Purchaser/Winner of the art piece, that piece shall immediately become your responsibility and be at your risk. We are not responsible for loss or damage to any piece once it has been purchased.
  • Each and every art piece in the UPwithART auction is sold “as is, where is”. Bidders are strongly encouraged to carefully view pieces online before placing bids, and contact us if you have any questions.
  • We are not liable in any way whatsoever if your attempt to purchase is unsuccessful.
  • Purchaser/Winner place will be notified within 1 week of auction
  • Payment of the purchase price, plus applicable taxes and other charges, must be paid by 2 May 2014.
  • Payment on your purchase(s) will be charged to your credit card as given, and following notification of your purchase/win, unless you opt at this time for another payment method. If you are unreachable prior to the due date, 2 May 2014, Unity Project will charge your credit card in the total amount of your winning bid(s), will notify you and await your instructions for pick-up/shipping.
  • Any bid amount which is 125% or greater than the Fair Market Value, is considered a true donation to the Unity project charity and warrants the purchaser a charitable tax receipt in the amount of the difference between fair market value and price paid.

  • The PROXY BIDDING TERMS AND CONDITIONS, together with any additional terms and conditions, constitute the entire agreement (the “Agreement”) between you and Unity Project regarding the use of proxy bidding with respect to the auction on 12 April 2014
  • Definitions: “you” are an individual acting on our own behalf; “we” and “us” means Unity Project for Relief of Homelessness in London and its proxy bidding delegates
  • A $20 non-refundable proxy bidding registration fee will be applied and charged to your credit card upon registration (i.e. submitting a proxy bid form). We will keep this credit card number to charge purchase(s) in the event you are an auction winner.
  • By completing and submitting the below proxy bid form, you warrant that: (i) you agree to all terms and conditions; (ii) you are at least 18 years of age and possess the legal capacity to participate in the UPwithART auction; (iii) you will be financially responsible for the use of proxy bidding services; (iv) you will be responsible for any usage by minors or any other party of proxy bidding services under your name or account.
  • You are solely responsible for the accuracy, completeness and truthfulness of the proxy bidding form
  • You must complete the proxy bidding form below, showing the maximum price which you authorize the auctioneer to bid for a particular art work. The maximum price to which we are authorized to bid must be a whole number and an increment of $10
  • Bids will be made in amounts no less than the minimum bid required for each item and in competitive increments of $10 (CDN).
  • The amount of your maximum bid will not be disclosed to any other proxy delegate or person either during or after the sale
  • Your proxy delegate will bid competitively on your behalf to ensure you are not paying more than you would if you were bidding live, in person.
  • Any bid amount which is 125% or greater than the Fair Market Value, is considered a true donation to the Unity project charity and warrants the purchaser a charitable tax receipt in the amount of the difference between fair market value and price paid.
  • Bids placed using the proxy bidding form are firm commitments to purchase and may not be cancelled or retracted for any reason after 10 April 2014 at 12 pm
  • The completed forms must be submitted by 10 April 2014, 12 pm
  • We will contact you to confirm receipt of your proxy bid form within 24 hours of submission
  • You must notify us prior to 10 April 2014 at 11:59 pm if your phone number, email, mailing address or credit card information has changed
  • We reserve the right not to bid on your behalf if there should be any error or confusion in respect to the instructions outlined on the proxy bid form

  • The winning bidder for a particular art piece shall have purchased this art piece at the accepted bid amount
